1. Acceptance of Terms
By accessing and using the Cognify Data platform ("Service"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Service.
These Terms apply to all visitors, users, and others who access or use the Service. By using the Service, you agree that you are at least 16 years of age and are legally capable of entering into binding agreements.
2. Account Registration
To access certain features of the Service, you must register for an account. When you register, you agree to:
- Provide accurate, current, and complete information during the registration process
- Maintain and promptly update your account information to keep it accurate and complete
- Maintain the security of your password and accept all risks of unauthorized access to your account
- Maintain only one account per person -- duplicate accounts may be terminated

3. Use of Services
Cognify Data provides access to interactive data labs, learning resources, and educational content. Your use of these services is subject to the following conditions:
- Lab Access: Labs are available based on your subscription tier or credit balance. Each lab has defined resource limits and time allocations.
- Credits System: Certain labs and features require credits to access. Credits are consumed when you start a lab session.
- Fair Usage: You agree to use the Service in a manner that does not disrupt or interfere with other users' experience or the platform's infrastructure.
- Learning Content: All course materials, lab instructions, and educational resources are provided for personal learning purposes only.
4. Intellectual Property
All content on the Cognify Data platform, including but not limited to text, graphics, logos, images, lab content, course materials, software, and code examples, is the property of Cognify Data or its content suppliers and is protected by intellectual property laws.
You may not:
- Reproduce, distribute, or publicly display any content from the Service without prior written consent
- Modify, create derivative works from, or reverse engineer any part of the Service
- Use any data mining, robots, or similar data gathering methods on the Service
- Download or copy account information for the benefit of another party
5. Credits and Payments
Cognify Data operates on a credits-based system alongside subscription plans. By purchasing credits or subscribing, you agree to the following:
- Non-Refundable: All credit purchases are final and non-refundable unless required by applicable law
- Pricing: Pricing for credits and subscription plans is subject to change. We will provide advance notice of any price changes to existing subscribers.
- Expiration: Credits may have an expiration period as specified at the time of purchase
- Subscription Billing: Subscription fees are billed in advance on a recurring basis according to your selected plan (monthly or annually)
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
6. User Conduct
You agree not to engage in any of the following prohibited activities:
- Sharing your account credentials with others or allowing multiple people to use a single account
- Attempting to gain unauthorized access to other users' accounts or the platform's systems
- Using the Service for any illegal or unauthorized purpose
- Uploading or transmitting viruses, malware, or any other harmful code
- Scraping, crawling, or using automated means to access the Service without our written permission
- Harassing, abusing, or threatening other users
- Misrepresenting your identity or affiliation with any person or entity
- Redistributing or reselling lab content, solutions, or educational materials
7. Limitation of Liability
To the maximum extent permitted by applicable law, Cognify Data and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorized access, use, or alteration of your transmissions or content
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.
8. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Grounds for termination include, but are not limited to:
- Violation of these Terms and Conditions
- Engaging in fraudulent or illegal activity
- Sharing account access with unauthorized users
- Abusing platform resources or infrastructure
- Non-payment of fees or charges
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
9. Changes to Terms
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the "Last Updated" date.
Your continued use of the Service after any changes to the Terms constitutes acceptance of those changes. It is your responsibility to review these Terms periodically for updates.
